Negligent Operation Led to Sepsis and the Death of 61 Year Old Patient
Mr X, aged 61, was the unfortunate victim of medical negligence following an operation at a hospital within a North of England NHS Foundation Trust.
Mr X undertook an operation to deal with some small growths in his bowel and had this been successful he should have made a full recovery after about six weeks. However, an anaestomic leak occurred when the surgeon failed to ensure that the suturing of the bowel was air tight. As a result faecal matter leaked into the abdominal cavity resulting in sepsis. In addition, the overflow bag was not fixed correctly. These issues went undiagnosed until too late and despite an attempt at corrective surgery Mr X died.
Mr X’s widow approached Applebys’ Clinical Negligence Unit to assist in gaining justice for her husband. Applebys experts have fought very hard on behalf of Mrs X to ensure that all issues were properly investigated and that appropriate compensation was received. Despite the Trust denying liability at all stages, resulting in a lengthy and drawn out case, a decision was reached in June 2016. Whilst there was still no admission of liability by the Trust they did settle out of Court for £75,000.00. All of which will go to Mrs X.
Graham Balmforth, the Head of Applebys Clinical Negligence Unit commented “This was an extremely distressing case for all concerned, especially as errors during surgery should have been identified sooner.” He continued “The grief stricken family not only had to deal with the death of a loved one but this was compounded by the defendant’s persistent stance regarding whether they were negligent or not.” Graham concluded “Ultimately, whilst the money cannot replace a family member or ease the pain felt by those left behind it can at least assist his widow financially in the future as well as provide an element of justice.”
